TERMS OF SERVICE

1. GharShar is a Peer-to-Peer Intermediary Utility

GharShar operates strictly as a free, open digital directory and information venue. We function as an Intermediary Platform under Section 79 of the Information Technology Act, 2000.

• We do not own, manage, inspect, or verify any properties listed on the application.
• We do not verify the identity, background, or creditworthiness of any users (landlords or tenants).
• We do not act as a real estate broker or agent and charge zero mandatory commissions or transaction fees.

2. User Responsibilities and Due Diligence

Because we are a neutral matching board, you are solely responsible for your offline safety and financial transactions:

• Verification: Users are strictly advised to conduct thorough background checks, verify legal property title deeds, and visit properties only in safe, daylight hours with proper accompaniment.
• No Financial Liability: GharShar does not process rental deposits, rents, or booking fees. Never send money to a landlord or host before physically inspecting a property and executing a formal lease agreement. GharShar is completely immune to any financial fraud or scams perpetrated by users.

3. Prohibited Content and Listings

When posting on GharShar, you agree that you will not upload any content that:

• Is fraudulent, fake, or misrepresentative of the actual property.
• Belongs to an un-registered major commercial builder project under construction that lacks a mandatory State RERA registration number.
• Violates any local municipal zoning laws or housing rules.
• Contains malicious software, spam, or phishing links.

GharShar reserves the absolute right to instantly remove any listing or ban any user profile flagged for fraudulent activity without prior notice.

4. Voluntary Contributions and Donations

GharShar is built as a community-driven tool. Any financial support provided to the platform via our "Tip Jar," UPI triggers, or donation links is entirely voluntary. These payments are non-refundable contributions intended solely to support server maintenance, database hosting costs, and ongoing platform development. Providing a donation does not grant any special privileges or establish a commercial service-provider relationship.

5. Limitation of Liability

To the maximum extent permitted by Indian law, GharShar, its founder, and its developers shall not be held liable for any direct, indirect, incidental, or consequential damages, including but not limited to financial losses, property damage, personal injury, assault, emotional distress, or criminal activities arising out of your offline interactions with individuals met through this platform.

6. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of the use of this digital service shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.
